The emu project is totally legal. The client hasn't been touched and the server has been built from the ground up up by a team of devs who all used to play the game and are still avid supporters.
The launcher launches a proxy that redirects the client to their own servers. It's currently in a pre alpha stage, but coming on nicley. They have made their own tools to create content and improve compatability. There has been no official statment from EA, nor have EA intervened or sent any form of communication to the team.
They are doing some great work.. screenies! (the game looks old, but still plays great and Highly addictive).
