Question - Price changed on order ...

If I pre-ordered an item from Amazon which was 65 pounds and then it changed before the release date to 120 quid but my invoice still says the charge is 65 pounds because obviously I have not agreed to pay like 120 quid so my question is can then legally take the extra money or would they have to ask....or third sell it to me for the agreed price ??

I would have thought that they would have to sell you the item at the agreed price, but I'm not a legal expert so couldnt be sure. I would drop them an email and see what they say tbh.

Depends on the order small print. If it says price may vary from original then your stuffed ( or something along those lines ) whereas if it says that it is the price you pay then they cant charge you more even if it goes up to £1000+

Check your order confirmation to see if you get it at the price stated or the price once in stock.

Check your "invoice" carefully as I suspect it probably isn't really an invoice (in the legal sense). I seem to remember that Amazon only take the cash when the order is processed: item in stock, etc. I suspect careful wording of all the documents/emails they send basically delays any "contract" between you and them up until the point of dispatch. So your option would be to cancel the order before this or pay the new price, I doubt they are legally obliged to sell to you at the lower price.

I got a couple of games pre-orderd at play.com (about £17). A few months later they tend to go up in price (to about £25-30). I still pay the price I have pre-ordered them on.
Still have UT3 on pre-order at £18 and now is £25 I'm still paying £18

Personally I would say go to the Citizens adivce Bureau about anything like this and get some proper legal advice if you think you've been ripped off.

If you had an agreement to pay a spcific price and have phyisical evidence to back that up, then i'm 99% certain that they are then bound by some part of the Consumers act and have to either cancel your order, honour the contract or advise you in advance that the price of the item has changed and that you would have to pay a different fee.

I would read through every sngle detail very carefully as Harv has said too though, as i'm sure a mssive company like Amazon would almost certainly have every possible scenario covered many times over.

As said though, go see CAB about it, but only after having read through everything carefully.

as cinty said.. most companies sell at the advertised price.

the law states that if you order a product at an advertised price they legally have to sell it at that price. its to do with trades description and another consumer law (im too tired to think at the moment)

however if the price has gone up, and they are unwilling to sell at the reduced price they cannot take the money out, they have to ask your permission, as the "invoice" is a legally binding contract, providing it has the cost on there that you agreed to pay, if they want to increase it they have to ask you for permission.
